image AML Regulations Take Effect in Curaçao

The Curaçao Gaming Board has implemented new anti-money laundering (AML) regulations, aimed at combating money laundering, terrorist financing, and the proliferation of weapons of mass destruction (AML/CFT/CPF) across both land-based and online casinos. These regulations, which took effect in January 2025, come with a three-month transitional period, after which full compliance will be mandatory.

The updated framework introduces a risk-based approach, requiring casinos to tailor their AML measures based on identified risks. This allows resources to be allocated efficiently, with enhanced scrutiny for higher-risk transactions and simplified procedures for lower-risk cases.

A major component of the regulations is customer due diligence (CDD), which mandates casinos to verify customer identities and monitor transactions above NAf. 4,000 ($2,130). Enhanced due diligence (EDD) is required for higher-risk customers, including politically exposed persons (PEPs) or residents of high-risk jurisdictions. Casinos must also report unusual transactions to the Financial Intelligence Unit (FIU) of Curaçao.

The regulations further require casinos to establish a comprehensive AML compliance program, ensuring adherence to international standards, particularly those set by the Financial Action Task Force (FATF). This move reflects Curaçao’s commitment to enhancing transparency and reinforcing its gambling sector’s reputation on the global stage.

In December 2024, Curaçao’s Parliament approved the National Ordinance for Games of Chance (LOK), signaling broader efforts to modernize the gambling industry. While these AML measures present new compliance challenges, they are expected to improve regulatory oversight and position Curaçao as a credible jurisdiction for online gaming. Operators will need to swiftly adapt, investing in stronger compliance frameworks and personnel to meet these elevated regulatory expectations.
